Harassment Training, A Pro-active Path The most effective way to deal with sexual harassment is to prevent it, rather than trying to repair the damage after it has occurred. Under the Massachusetts Commission Against Discrimination’s (MCAD) Sexual Harassment in the Workplace Guidelines, employers are encouraged to conduct harassment training programs for all employees, including supervisors and managers. The training for supervisors and managers should include methods to ensure immediate and appropriate corrective action in addressing sexual harassment complaints. The Guidelines state that “[i]n claims alleging sexual harassment, an employer’s commitment to providing anti-harassment training to its workforce may be a factor in determining liability or the appropriate remedy.” Further, as the Guidelines note, the use of training will reduce the risk that an employer may be liable for punitive damages.
